There is no minor injury cap. Instead the Automobile Insurance Act takes a deductible off pain and suffering damages in every motor vehicle claim. The Limitations Act gives two years for a personal injury claim, with discoverability, and the clock does not run while the claimant is a minor. A claim based on sexual misconduct has no limitation period. Where WorkplaceNL covers a workplace injury, the worker cannot sue the employer. A claim may still lie against a third party outside the scheme.
